These Terms and Conditions apply to all transactions on this site. Please read them carefully.
Practical Self Protection Policies
All Practical Self Protection Policies, available Products and Services, and all encompassing agreements are provided at www.practicalselfprotection.com, and are dictated by those effective on the date of this Contract.
“Practical Self Protection”, “Practicalselfprotection.com”, “www.practicalselfprotection.com”, “we”, or "us" and/or "our" means Practical Self Protection, the Product and/or Service vendor.
“You” or “yours” means a natural person or company who orders Products or Services from Practical Self Protection.
“Contract” is the contract containing these terms and conditions, formed by Practical Self Protection’s acceptance of your order, and credit card or other payment details;
“Products” are the products listed for sale on the Practical Self Protection website;
“Services” are any services available from Practical Self Protection made available from time to time through the Practical Self Protection website.
“International” refers to selling into any country outside of Europe and the EU member states.
1.00 The owner of this site is Practical Self Protection
1.01 The sale of Products and/or Services and these terms and conditions shall be governed by and construed under the laws of England, United Kingdom. For all disputes, you hereby submit to the exclusive jurisdiction of the Courts of England, United Kingdom and that any legal action pursued by you shall be within the exclusive jurisdiction of the Courts of England, United Kingdom.
1.02 This agreement is being written in English, which is to be the official language of the contract’s text and interpretation.
1.03 These terms and conditions apply to any order, purchase, receipt, delivery or use of any Products from us and no other terms and conditions shall apply. These terms and conditions do not affect your statutory rights, which cannot be waived or limited by contract. We reserve the right to amend these terms and conditions, including payment and warranty terms, without notice to you.
1.04 We may amend these Terms and Conditions at any time and place the version on the site. When Practical Self Protection do so, it will mention the fact on our home page (www.practicalselfprotection.com). For users purchasing goods or registering on the Site for the first time, all purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms Otherwise, such changes will be effective against existing users thirty days following posting of the amended version on the Site. Your continued use of the Site following Practical Self Protection’s posting of any changes will constitute your acceptance of such changes. Frequent review of our website and these terms and conditions is recommended. Contracts concluded on the basis of previous terms and conditions remain unaffected. An updated version of the terms and conditions will be available to you at all times on this website and it is your responsibility to review this periodically. If you do not agree to any changes to these Terms, then your only remedy is to cease using the Site.
1.05 These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Practical Self Protection and you relating to your purchase. Practical Self Protection advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by Practical Self Protection. You are advised to read (and are responsible for reading) fully all information on this website.
2.00 The Site
2.01 The Practicalselfprotection.com Site is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the Practical Self Protection Site you agree to be bound by these Terms and Conditions.
2.02 Text, graphics, software and any other material are owned by Practical Self Protection. Anyone is entitled to view the Site and to print pages of this Web Site for the sole purpose of placing an order with Practical Self Protection.
2.03 You must be eighteen years old to use this site. If you are under eighteen, you may only use the Site in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the site.
2.04 Your contract for purchases made through the Site is with Practical Self Protection, and you undertake that any and all goods ordered by you are for your own private and domestic use only.
3.00 Internet Orders
3.01 You will have the opportunity to check and correct any input errors in your order up until you click the Submit Order button. The website may automatically identify and/or alert you to certain types of input error before you place your order. However it may not identify all errors or omissions particularly information that may have been entered by you and you should ensure that the information you submit in your order is accurate and complete.
3.02 After you submit an order we will give you an Order Reference Number and details of the products you have ordered. We will send the same details to you in an email acknowledging receipt of your order (Order Confirmation). This is an acknowledgement of your order, not acceptance.
3.03 No contract for the sale of any product will subsist between you and Practical Self Protection until practical protection dispatches the product(s) ordered. We will confirm that the product(s) have been dispatched by a confirmation email (Order Dispatched). This confirmation email amounts to an acceptance by Practical Self Protection of your offer to buy goods from Practical Self Protection (whether or not you receive that email).
3.04 You agree that email can be used as a long-distance means of communication.
3.05 The confirmatory email will contain a link to these terms and conditions, and may be amended in accordance with paragraph 1.01 above from time to time.
3.06 You must check that the details on this confirmatory email are correct as soon as possible and you should print out and keep a copy.
3.07 Practical Self Protection will not pass your personal or credit or debit card details to any third party except where an additional security check may be deemed necessary. We shall be entitled to process your data in accordance with our Privacy Policy (see section 7.00).
3.08 You undertake that all details you provide to Practical Self Protection for the purposes of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services offered.
3.09 We will notify you if your payment details cannot be authorised for any reason and may invite you to pay by another method.
3.10 It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Practical Self Protection tracks the electronic ‘fingerprints’ of every order placed with Practical Self Protection to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.
3.11 All purchases are non-exchangable, non-refundable and non-transferable.
3.12 You may cancel your order at any time prior to your order being processed by clicking on the ‘cancel’ link next to the product ordered on your account page on the website. You may also withdraw from the contract at any time after the product has been dispatched and you have received our email confirming your order but no later than 7 working days after the day after you receive the product by:
3.121 sending the notice of cancellation by email to accounts@practicalselfprotection.com ensuring that you quote your name, address and order reference number; or
3.122 sending notice of cancellation by first class recorded post to Practical Self Protection (please email us for address where cancellations can be sent).
3.123 where you have already received the goods, returning the goods to Practical Self Protection unopened together with the original invoice. Practical Self Protection will refund you the purchase price of the goods. Where appropriate Practical Self Protection shall refund any additional customs duties borne by you on receipt of the relevant customs receipt.
3.13 Once Practical Self Protection receives notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited to Practical Self Protection from your credit card in relation to your order will be re-credited to that credit card account as soon as possible and in any event within 30 days of your order provided that the goods you wish to return are received by Practical Self Protection in the condition that they were in when delivered to you. You will be liable for any charges incurred in returning the goods to Practical Self Protection. Furthermore you assume all risk of loss and damage to Products while in transit to us.
3.14 Practical Self Protection reserves the right to refuse to accept such goods that are not returned in mint condition, at its sole discretion. Practical Self Protection also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.
3.15 Where you have elected to make payment other than with a credit card (and we have accepted that payment option), we are entitled to consider an order or Contract cancelled with or without notice to you if we do not receive that payment within ten days of the date of the relevant order acknowledgement. Any purchase(s) made by cheque will not be dispatched until the funds have cleared in our account. Please allow up to five working days for cheques to clear from the date they are received by us.
3.16 All cheques should be made payable to Practical Self Protection with both the cheque card guarantee number and expiry date clearly written on the reverse of the cheque.
3.17 Third party cheques cannot be accepted.
3.18 You will be charged £25.00 in the event that any cheque presented as payment be returned to our bankers as unpaid for any reason whatsoever.
3.19 You will be liable for any charges incurred from a debt recovery agency.
4.00 Processing of Orders
4.01 Every purchase you make shall be deemed performed in England. English law shall govern every aspect of contractual agreement concerning purchases made from the Site. The sale of Products and/or Services and these terms and conditions shall be governed by and construed under the laws of England, United Kingdom. For all disputes, you hereby submit to the exclusive jurisdiction of the Courts of England, United Kingdom and that any legal action pursued by you shall be within the exclusive jurisdiction of the Courts of England, United Kingdom.
4.02 Practical Self Protection aims to arrange shipment of all items within 3 working days of receiving your order. Your order may be delayed if the item is not in stock with our suppliers.
5.00 Delivery
5.01 The period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order and stated in the Order Confirmation. Please note that your goods may be sent to you in instalments. You may cancel your entire order with us if subsequent instalments forming part of your order are not delivered by us.
5.02 If your delivery address is outside of England, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; Practical Self Protection advises each customer to contact their local customs office for further information.
5.03 Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.
5.04 Some parcels have to be signed for when delivered. If someone will not be available for accepting the parcel, the parcel is retained at the local depot and will be held for a period determined by the delivery company. Any charges for this plus an additional £5.99 will be borne by you for redelivery. If this is likely to happen it may be advisable to provide us with an alternative delivery address.
5.05 Deliveries must be checked by you before signing receipt from carrier. Practical Self Protection will not be responsible for goods damaged in transit if signed for with no reference to condition delivered in.
5.06 You must notify us within 1 day of receipt of the item(s) by email where there are any shortages or damage. Signed proof of carrier is required where complete parcel is damaged or there are shortages of items.
5.07 Where goods are lost, damaged or distorted after delivery, and the ownership has yet to pass, the purchaser will indemnify us against this loss provided it has not resulted from our negligence.
5.08 Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery by us.
6.00 Notices and Communication
Each party (i.e. you or us) may send notices or communications to the other by personal delivery, e-mail, regular mail or fax. Notices or communications must be sent to the latest contact details specified by the receiving party. Notices and communications will be considered received by the addressee (as applicable) if (1) by courier or other mode of personal delivery, on the date of personal delivery to such addressee’s address as last specified by that addressee before dispatch; or (2) by posting, 5 working days after the date of registered posting (by airmail, delivery receipt requested) to the addressee’s address last specified by the addressee before posting; or (3) by facsimile, contemporaneously with facsimile transmission to the facsimile number last specified by the addressee before transmission, with delivery being evidenced by an appropriate successful transmission contact report. E-mail communications shall be considered received by the addressee on the earlier of (1) the earliest time at which the e-mail is accessible by the addressee; (2) receipt by the sender of a delivery receipt message indicating successful delivery to the intended addressee’s e-mail address, or (3) the expiry of 48 hours from the sending of the email; provided that if at any point the sender receives notification that the e-mail has not been successfully transmitted to an addressee then the e-mail shall not be deemed to have been received by that addressee. Order cancellations by you via e-mail shall only be effective upon express acceptance thereof by us. We may at our option accept orders and acknowledge, accept or effect other communications by telephone. Telephone communications by us shall be as effective as written communications.
7.00 Data Protection and Privacy
7.01 By submitting your orders:
7.011 You consent to the processing of any personal information, such as your name and title, address, telephone number, contact details and other personal details (“Personal Data”).
7.012 You acknowledge that the processing of your Personal Data is necessary for the performance of the Contract and you consent to such processing.
7.02 We may share, make available or transmit Personal Data to other Practical Self Protection affiliated companies and you consent to the transfer of your Personal Data to any such company outside the European Economic Area (subject to Practical Self Protection’s strict compliance with the Data Protection Acts 1998 and 2003). We will not disclose Personal Data to entities and persons, other than Practical Self Protection affiliated companies, (“Third Parties”) without your consent, except in the cases below:
7.021 Personal Data may be disclosed to Third Parties to enable the performance of contracts you are party to or for other purposes specified in these terms and conditions;
7.022 Personal Data may be disclosed to Third Parties to enable compliance with legal obligations to which we or other Practical Self Protection affiliated companies are subject;
7.023 Personal Data may be disclosed to Third Parties to enable them to provide services for or on behalf of, or at the direction of, us or other Practical Self Protection affiliated companies. In such cases, we take measures to ensure that the Third Parties comply with our privacy policy and other such recipients:
7.0231 Do not use Personal Data other than for the purposes permitted;
7.0232 Obtain and process Personal Data only on condition that Personal Data is secure from unauthorised use and that they adopt and comply with similarly stringent policies and terms on Personal Data protection and use, and
.0233 Comply strictly with applicable laws.
7.03 You may request us to inform Third Parties to whom Personal Data has been communicated of corrections or deletions to that Personal Data. If we do not have control of that Personal Data, we will use its reasonable efforts to communicate your corrections and deletion requests. However, where Personal Data has been transferred to credit card payment and certain other agencies for payment processing, you may need to contact such agencies directly if you wish Personal Data transferred to those agencies to be rectified or deleted. We exclude all responsibility for rectifying or deleting Personal Data that has been transferred (with your consent) to certain agencies such payment processing agencies that require and/or assume control of that data.
7.04 Please note that certain portions of our website may employ cookies (small pieces of data placed on your hard disk drive when you access a website or a certain part of a website) in order to learn more about your browsing habits on such websites and/or to personalise your visit to the website. By accessing our websites, you agree to this use of cookies.
8.00 DVDs and eBooks
8.01 The purchaser is responsible for any censorship, content or import restrictions in the country of delivery.
8.02 Practical Self Protection is the owner and exclusive licensee throughout the world of the copyrights in all goods, including, but not limited to, DVDs, Books, Audio Books and eBooks sold on this website (www.practcicalselfprotection.com). The DVDs, Books, Audio Books and eBooks are protected by the laws of England.
8.03 Copying of any of the DVDs, Books, Audio Books and/or eBooks or any part of the DVDs, Books, Audio Books, and/or eBooks, their packaging, trade dress or content is strictly forbidden. The DVDs, Books, Audiobooks and eBooks are provided to you under limited license to enjoy for your personal use only. Any copying, decompilation, publication, storage in a retrieval system, alteration or transmission in any form or by any means in whole or part without the prior written approval of Practical Self Protection constitutes an infringement and will be prosecuted to the full extent of the law.
9.00 LIABILITY DISCLAIMER
9.01 THE INFORMATION, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH PRACTICAL SELF PROTECTION MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. PRACTICAL SELF PROTECTION MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE PRACTICAL SELF PROTECTION WEB SITE AT ANY TIME. ADVICE RECEIVED VIA PRACTICAL SELF PROTECTION SHOULD NOT BE RELIED UPON FOR PERSONAL, MEDICAL, LEGAL OR FINANCIAL DECISIONS AND YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL FOR SPECIFIC ADVICE TAILORED TO YOUR SITUATION.

9.03 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRACTICAL SELF PROTECTION BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, PROPERTY DAMAGE, PERSONAL INJURY, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE PRACTICAL SELF PROTECTION WEB SITE, WITH THE DELAY OR INABILITY TO USE THE PRACTICAL SELF PROTECTION WEB SITE OR RELATED PRODUCTS OR SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, PRODUCTS AND SERVICES OBTAINED THROUGH THE PRACTICAL SELF PROTECTION WEB SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE PRACTICAL SELF PROTECTION WEB SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF PRACTICAL SELF PROTECTION HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
9.04 YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES PRACTICAL SELF PROTECTION IS NOT LIABLE NOR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE GREAT BRITISH POUND (£) AMOUNT YOU PAID FOR THE PURCHASE GOVERNED BY THIS AGREEMENT.
9.05 NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PRATICAL SELF PROTECTION SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY, AND YOU MAY NOT RELY ON SUCH INFORMATION OR ADVICE TO DO SO.
9.06 IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE PRACTICAL SELF PROTECTION WEB SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE PRACTICAL SELF PROTECTION WEB SITE.
10.00 Miscellaneous
10.01 We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
10.02 We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.
10.03 No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.
10.04 You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. Practical Self Protection reserves the right to bar any such activity.
10.05 You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any Practical Self Protection server, or to any of the services offered on or through the Site, by hacking, password “mining” or any other illegitimate means.
10.06 You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of Practical Self Protection, including any Practical Self Protection account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.
10.07 You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or Pratical Self Protection’s systems or networks, or any systems or networks connected to the Site or to Practical Self Protection.
10.08 You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site.
10.09 In these Terms, ‘Intellectual Property Rights’ means patents, database rights, copyright, design rights (whether registered or unregistered), trade marks (whether registered or unregistered) and other similar rights, together with the right to apply for the protection of any such rights. All Intellectual Property Rights in the Site shall be owned by us absolutely.
10.10 Subject to the licence granted to you to use the Site, Practical Self Protection reserves all rights, title and interest in its Intellectual Property Rights in the Site. Any goodwill accruing from use of Practical Self Protection and its affiliates’ trade marks, trade and business names and service marks under this Agreement will vest in Practical Self Protection and its affiliates, as appropriate.
10.11 We reserve the right to terminate this Agreement and to suspend or terminate your access to the Site immediately and without notice to you if:
10.111 you fail to make any payment to us when due;
10.112 you breach the terms of this Agreement (repeatedly or otherwise);10.113 when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity;
10.114 we suspect you have engaged, or about to engage, or have in any way been involved, in fraudulent or illegal activity on the Site.
10.12 These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Practical Self Protection and you relating to your purchase. We will store a copy of the contract entered into by you with Practical Self Protection. You are advised to read (and are responsible for reading) fully all information on this website.
10.13 You will not register or use any Internet domain name that contains a Practical Self Protection trademark or trade name (i.e. Practical Self Protection) in whole or in part or any other name that is confusingly similar thereto.
10.14 You agree that you are buying the Products for your personal non-commercial use and you shall not resell any of our Products nor duplicate them in any form or fashion. We reserve the right to reject orders placed by you if you breach this term or if we reasonably suspect that you have breached or will breach this term.
10.15 The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived there from. If any provision of these terms and conditions is found by a court of competent jurisdiction to be unenforceable, the enforceability of the remaining provisions shall not be affected or impaired.
10.16 These Terms are subject to the laws and exclusive jurisdiction of England, United Kingdom.
